Provincial Legislation:

It is the fiduciary responsibility of the owners to maintain the common property

Federal Legislation:

 The Supreme Court of Canada considered Poly B non-admissible to indemnity clauses in 2005. As a result, insurance companies must not insure homes with Poly B piping.
